Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your", or "User") and AI LABS ("we", "us", or "our"), the operator of AI Wizardry — the website at aiwizardry.app, the AI Wizardry mobile applications, and all related services, content, and features (together, the "Service"). They govern your access to and use of the Service.

By creating an account, clicking "I agree" or any similar control, or otherwise accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Service.

If you use the Service on behalf of an organization, school, or other entity, you represent that you are authorized to bind that entity, and "you" includes both you and that entity.

Please read the sections on Disclaimers of Warranties, Limitation of Liability, and Governing Law and Dispute Resolution carefully — they limit our liability and affect your legal rights, including how disputes are resolved.

2. Definitions

  • Account — the personal account you create to access the Service.
  • Content — text, prompts, responses, scores, certificates, usernames, portfolios, and other materials available through the Service.
  • User Content — Content you submit, upload, or generate, including the prompts you write and any profile, username, or portfolio information.
  • AI Features — features that use third-party artificial-intelligence models (currently Google's Gemini family) to evaluate prompts, generate sample responses, grade exercises, and produce feedback.
  • Subscription — a paid plan giving access to premium features, once paid plans become available.
  • Beta — the current free public testing phase of the Service.

3. Eligibility and Account Registration

You must be at least 13 years old to use the Service. If you are in the European Economic Area (EEA), the United Kingdom, or another jurisdiction that sets a higher minimum digital-consent age, you must be at least 16, or the minimum age set by your country. By using the Service you represent that you meet these requirements and are not barred from using the Service under the laws of your jurisdiction.

To access most features you must register an Account with accurate, current, and complete information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your Account. Notify us immediately at security@aiwizardry.app if you suspect any unauthorized use. We are not liable for any loss arising from your failure to keep your credentials secure.

You may not (a) create an Account for anyone other than yourself without permission, (b) use another person's Account, (c) create multiple Accounts to abuse free quotas, promotions, or limits, or (d) provide false information. We may refuse, suspend, or terminate Accounts at our discretion, including for suspected fraud or violation of these Terms.

4. The Service; Educational Purpose

AI Wizardry is an educational platform that teaches prompt engineering and AI literacy through interactive levels, courses, practice challenges, real-world use cases, AI-assisted feedback, and shareable certificates. The Service is provided for general educational and informational purposes only.

The Service does not provide professional, legal, medical, financial, employment, or other regulated advice, and nothing in it should be relied upon as such. Any decision you make based on the Service is your own responsibility.

5. Beta Service

The Service is currently offered as a free public beta. It is provided on an "as is" and "as available" basis and may contain errors, bugs, or inaccuracies. Features may be added, changed, suspended, limited, or removed at any time without notice or liability. We do not guarantee that the Service, your data, or any Content will be available, preserved, accurate, or error-free during the beta or at any time.

We may use feedback you provide about the beta to improve the Service. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use such feedback for any purpose without obligation or compensation to you.

6. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your own personal, non-commercial learning, or — for Team or Organization plans — for the internal training purposes expressly permitted by your plan. All rights not expressly granted are reserved by us.

7. Teams and Organizations

If you create or join a Team or Organization, the account owner ("Admin") may invite and remove members, manage seats, and view members' learning progress and certificates associated with the Team for administrative and training purposes. Admins are responsible for (a) having a lawful basis and any necessary consents to add members and process their information, (b) the conduct of their members, and (c) all fees associated with their seats. Members are subject to these Terms in addition to any policies set by their Admin.

8. Subscriptions, Billing, Renewals, and Refunds

During the beta, all learning content is available free of charge and no payment is required. We intend to introduce paid Subscriptions in the future. When we do, the provisions below apply, and the then-current prices, billing cycles, and plan features will be presented to you before you purchase. Your purchase of a Subscription, or your continued use after paid plans launch, constitutes acceptance of the payment terms then in effect.

Pricing and taxes. Prices, currencies (including Bangladeshi Taka), applicable taxes, and billing cycles (such as weekly, monthly, or yearly) will be displayed at the point of purchase. You authorize us and our payment processors to charge your selected payment method for all applicable fees and taxes. You are responsible for any taxes, currency-conversion fees, or bank charges that apply to your purchase.

Payment processors. Payments are processed by third-party providers, which may include SSLCommerz, Stripe, the Apple App Store, and Google Play. We do not collect or store full payment-card details; those are handled by the processor under its own terms and privacy policy. Subscriptions purchased through an app store are also governed by that store's terms, and refunds or cancellations for those purchases may be controlled by the store.

Automatic renewal. Unless stated otherwise, Subscriptions renew automatically at the end of each billing cycle at the then-current price until you cancel, and we or the applicable app store will charge your payment method at the start of each renewal term. Where required by law, we will provide advance notice of renewals or material price changes.

Cancellation. You may cancel a Subscription at any time through your account settings or, for app-store purchases, through the app store. Cancellation stops future renewals; it does not retroactively refund the current term, and you retain premium access until the end of the paid period, except where mandatory law requires otherwise.

Refunds. Except where required by mandatory consumer-protection law (for example, statutory withdrawal or "cooling-off" rights in the EU/UK) or by an app store's policy, all fees are non-refundable and there are no refunds or credits for partially used periods. Nothing in these Terms limits any non-waivable statutory refund or cancellation right you may have.

Price changes. We may change prices or introduce new charges. Changes will not apply retroactively to a billing cycle you have already paid for, and we will give notice as required by law before a change takes effect. If you do not agree to a price change, your sole remedy is to cancel before the change applies.

9. User Content and Public Profiles

You retain ownership of the prompts and other User Content you create. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, display, and transmit your User Content as necessary to operate, provide, secure, and improve the Service — including transmitting your prompts to our AI providers for evaluation, and displaying Content you choose to make public.

Public content. Certain features let you publish Content visible to anyone, including your chosen username and public profile, shareable certificates available at public links, public portfolios, and community "exemplar" submissions selected for peer display. Do not include anything in public Content that you are not comfortable making permanently public, and do not include other people's personal data. Public Content may be cached, indexed by search engines, or copied by third parties beyond our control.

Your responsibilities. You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third party's rights or violate any law or these Terms. You are solely responsible for your User Content and the consequences of submitting it.

Our rights. We may, but are not obliged to, review, moderate, refuse, remove, or disable access to any Content that we believe violates these Terms or applicable law, or that may harm the Service or others, without liability to you.

10. AI Features; No Reliance

The Service uses third-party artificial-intelligence models to evaluate your prompts, generate sample AI responses, grade exercises, and produce scores and feedback. AI output is generated automatically and may be inaccurate, incomplete, outdated, biased, or otherwise unreliable. Scores, feedback, and generated text are provided for educational purposes only and do not constitute professional advice or a statement of fact.

You must independently verify any information before relying on it. We do not warrant the accuracy, quality, or suitability of any AI-generated output, and we are not responsible for any action you take based on it.

Do not submit sensitive information. Because your prompts are transmitted to third-party AI providers, you must not submit prompts containing sensitive personal data (such as government identifiers, or health, financial-account, or biometric information), confidential information, or anyone else's personal data without authority. You are responsible for the content of your prompts.

11. Certificates and Credentials

Certificates issued by the Service recognize completion of learning activities within AI Wizardry. They are not accredited qualifications, academic degrees, or professional licenses, and they do not guarantee any skill level, employment, or other outcome. We may verify, withhold, suspend, or revoke a certificate that we reasonably believe was obtained through fraud, error, automation, or a violation of these Terms.

12. Acceptable Use

You agree not to, and not to attempt to or permit others to:

  • use the Service for any unlawful, harmful, fraudulent, infringing, or abusive purpose, or in violation of any applicable law or regulation;
  • submit, generate, or distribute Content that is illegal, defamatory, obscene, hateful, harassing, sexually exploitative (especially involving minors), violent, or that infringes intellectual-property, privacy, or other rights;
  • attempt to access, tamper with, or use non-public areas of the Service, other users' accounts or data, or our systems or networks, or circumvent any access controls, usage limits, quotas, paywalls, or security measures;
  • probe, scan, or test the vulnerability of the Service, or breach or circumvent any authentication or security, except under a security-testing program we authorize in writing;
  • use any bot, scraper, crawler, or other automated means to access the Service or collect data from it, except as permitted by our robots file or with our prior written consent;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or underlying ideas of the Service, except to the extent this restriction is prohibited by applicable law;
  • copy, resell, rent, lease, sublicense, distribute, or commercially exploit the Service or its Content except as expressly permitted;
  • use the AI Features to build or train a competing product or model, or to generate content that violates the AI providers' policies;
  • impose an unreasonable or disproportionately large load on the Service, interfere with its proper working, or introduce malware or conduct any denial-of-service activity;
  • misrepresent your identity or affiliation, or use the Service to send spam or unsolicited communications;
  • remove, obscure, or alter any proprietary notices.

We may investigate and take any action we deem appropriate for a suspected violation, including removing Content, suspending or terminating Accounts, and reporting to and cooperating with law-enforcement authorities.

13. Intellectual Property

The Service and all materials in it — including software, text, lesson and course content, graphics, designs, logos, the "AI Wizardry" name and marks, and the selection and arrangement of content — are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license in these Terms, no right, title, or interest in the Service is transferred to you. You may not use our names, logos, or trademarks without our prior written permission.

14. Copyright and Intellectual-Property Complaints

We respect intellectual-property rights and expect users to do the same. If you believe Content on the Service infringes your copyright or other rights, send a notice to legal@aiwizardry.app that includes: your contact details; identification of the work claimed to be infringed; identification and location of the allegedly infringing Content; a statement that you have a good-faith belief the use is not authorized; a statement that the information is accurate and, under penalty of perjury, that you are authorized to act; and your signature. We may remove allegedly infringing Content and terminate repeat infringers.

15. Third-Party Services

The Service relies on and links to third-party services, including Google Firebase and Google's Gemini AI, analytics, and payment processors. Your use of those services may be governed by their own terms and privacy policies. We do not control and are not responsible for third-party services, websites, or content, and we make no warranties about them. Your dealings with third parties are solely between you and them.

16. Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal information, and your choices and rights. By using the Service you acknowledge our Privacy Policy. Please review it carefully.

17. Termination and Suspension

You may stop using the Service and delete your Account at any time through your account settings. Deletion is permanent and removes your personal data as described in the Privacy Policy.

We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we believe you have violated these Terms or the law, if your use poses a risk to us, other users, or third parties, if required by law, or if we discontinue the Service. We may also terminate inactive or beta Accounts.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive — including ownership, User Content licenses, disclaimers, limitation of liability, indemnification, and dispute-resolution provisions — survive termination.

18. Disclaimers of Warranties

To the maximum extent permitted by applicable law, the Service and all Content and AI output are provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise. We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, timely, error-free, or free of viruses or other harmful components, that defects will be corrected, that any Content or AI output is accurate or reliable, or that the Service will meet your requirements or achieve any particular result. No advice or information obtained from us or through the Service creates any warranty not expressly stated here.

Some jurisdictions do not allow the exclusion of certain warranties or implied statutory rights, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum extent and shortest duration permitted by law, and nothing in these Terms affects non-waivable statutory or consumer rights.

19. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will AI LABS, or its owners, employees, contractors, suppliers, or licensors, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business, or anticipated savings, or for any cost of substitute services, arising out of or relating to the Service, your use of or inability to use it, any Content or AI output, or these Terms — whether based on contract, tort (including negligence), strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the total amount you paid us for the Service in the twelve (12) months immediately before the event giving rise to the claim, or (b) one hundred US dollars (USD 100) or its equivalent. During the free beta, where you have paid us nothing, our aggregate liability is limited to USD 100 or its equivalent.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — for example, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any non-waivable consumer rights. If you are a consumer, you may have legal rights that these Terms do not affect. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless AI LABS and its owners, employees, contractors, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms or of any law or third-party right; or (d) your breach of any representation or warranty in these Terms. We may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.

21. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, power or internet failures, or the failure of third-party services or suppliers.

22. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of Bangladesh, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before bringing any formal claim, you agree to contact us at legal@aiwizardry.app and attempt in good faith to resolve the dispute informally for at least sixty (60) days. Most concerns can be resolved this way.

Forum. Subject to the mandatory rights described below, the competent courts located in Dhaka, Bangladesh have exclusive jurisdiction over any dispute not resolved informally, and you and we submit to the personal jurisdiction of those courts.

Consumer rights. If you are a consumer habitually resident in a jurisdiction (such as the EEA or the UK) whose mandatory laws give you the right to bring proceedings in your local courts or the protection of your local consumer laws, nothing in this section deprives you of those rights, and those mandatory protections continue to apply.

Class-action waiver. To the maximum extent permitted by applicable law, you and we agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. This waiver does not apply where it is prohibited by the mandatory law applicable to you.

Time limit. To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be filed within one (1) year after it arises; otherwise it is permanently barred.

23. Changes to the Service and to These Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide reasonable notice — for example, by posting the updated Terms with a new "Last updated" date, or by email or in-app notice where appropriate — before they take effect. Changes are effective when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and may delete your Account.

24. General

  • Entire agreement — These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject.
  • Severability — If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force.
  • No waiver — Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment — You may not assign or transfer these Terms without our consent. We may assign them, for example in connection with a merger, acquisition, or sale of assets.
  • No third-party beneficiaries — These Terms create no third-party beneficiary rights, except that our owners, suppliers, and licensors may rely on the disclaimers, liability limits, and indemnities.
  • Relationship — No agency, partnership, employment, or joint venture is created by these Terms.
  • Export and sanctions — You represent that you are not located in, and will not use the Service in, a country or as a person subject to applicable trade sanctions or export-control restrictions.
  • Notices — We may provide notices to you by email, in-app message, or by posting on the Service.
  • Language — These Terms are written in English, which is the controlling language; any translation is for convenience only.
  • Headings — Section headings are for convenience only and have no legal effect.
